Terms and Conditions of Use

1. Agreement to Terms
These Terms and Conditions of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Autoimport Africa ("Company", "we", "our", or "us"), governing your access to and use of the autoimport.africa website, mobile applications, and all related services (collectively, the "Platform").
By accessing or using the Platform, creating an account, browsing vehicle listings, placing an order, or otherwise engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.
2. About the Platform
Autoimport Africa is an online marketplace that facilitates the importation of clean-title vehicles from China to African countries, including but not limited to Nigeria, Kenya, and Ghana. Our services include vehicle sourcing and listing with verified condition reports, escrow-protected payment processing, international vehicle shipping (via RoRo or container), customs clearance and import documentation, and door-to-door delivery.
Autoimport Africa acts as a facilitator and logistics coordinator. We are not the manufacturer, dealer, or direct seller of the vehicles listed on our Platform. Vehicle listings are based on inspections conducted by our third-party verification partners in China.
3. Eligibility
To use the Platform and our services, you must be at least 18 years of age and possess the legal capacity to enter into binding contracts under the laws of your jurisdiction. By using the Platform, you represent and warrant that you meet these eligibility requirements. If you are using the Platform on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.
4. Account Registration
Certain features of the Platform require you to create an account. When registering, you agree to provide accurate, current, and complete information, keep your login credentials confidential and secure, notify us immediately of any unauthorised use of your account, and accept responsibility for all activities that occur under your account.
We reserve the right to suspend or terminate your account at our sole discretion if we reasonably believe that your account information is inaccurate, that your account has been compromised, or that you have violated these Terms.
5. Vehicle Listings and Condition Reports
All vehicles listed on our Platform undergo an independent inspection in China, and each listing includes a detailed condition report with high-resolution photographs. While we make every effort to ensure the accuracy of these reports, you acknowledge and agree that:
- Condition reports are prepared by third-party inspectors and reflect the vehicle's state at the time of inspection. Minor discrepancies may exist.
- Photographs may not capture every defect or imperfection. You are encouraged to review all available documentation carefully before placing an order.
- Autoimport Africa does not guarantee that any vehicle will be free from all defects, wear, or mechanical issues. Vehicles are sold on an "as inspected" basis.
- Vehicle specifications, features, and descriptions are provided for informational purposes and may vary from the actual vehicle due to regional variations or manufacturer updates.
6. Orders and Payments
6.1 Placing an Order
When you place an order through the Platform, you are making an offer to purchase the selected vehicle subject to these Terms. An order is confirmed only when we issue a written order confirmation to you via email or through your account dashboard.
6.2 Pricing
All prices displayed on the Platform are in the applicable local currency or United States Dollars (USD) as indicated. Prices include the cost of the vehicle as listed but may not include customs duties, local taxes, port handling fees, inland transportation, or other charges specific to your destination country, unless expressly stated otherwise.
6.3 Escrow-Protected Payments
Payments are processed through our secured payment gateway with escrow protection. Funds are held securely and are only released to the vehicle seller once the vehicle has been verified and cleared for export from the Chinese port.
6.4 Payment Methods
We accept payments in local currencies through approved payment methods as indicated on the Platform. All payment processing is handled by our third-party payment partners.
7. Shipping and Delivery
7.1 Shipping Methods
Vehicles are shipped from China to your destination country via Roll-on/Roll-off (RoRo) vessels or dedicated container shipping, depending on availability and your preference.
7.2 Real-Time Tracking
Our Platform provides real-time GPS tracking, allowing you to monitor your vehicle's journey. Tracking information is provided for informational purposes, and actual transit times may vary.
7.3 Customs Clearance
Our licensed local clearing agents will handle all customs documentation, import duties, and local tax payments on your behalf. You agree to provide all necessary personal documentation in a timely manner.
7.4 Final Delivery
Once your vehicle has cleared customs, it will be transported to your doorstep or designated city hub. A final inspection and key handover will be conducted upon delivery.
7.5 Risk of Loss
All shipments are insured for full market value during transit. Risk of loss or damage transfers to you upon delivery and your acceptance of the vehicle.
8. Cancellations and Refunds
You may request cancellation of an order before the vehicle has been loaded for shipping. Cancellation requests must be submitted in writing to [email protected]. Refund eligibility and any applicable cancellation fees will be determined based on the stage of the transaction. Once a vehicle has been shipped, cancellations are generally not permitted.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTOIMPORT AFRICA, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO AUTOIMPORT AFRICA FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. Any legal proceedings arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Lagos, Nigeria.
